The Crisis of the Present Hour: 2025-2026

The theory of "Executive Energy" has, in the last six months, been transmuted into a practice of "Executive Usurpation." We identify three specific fronts where the Constitution is in active retreat.

I. The War Without Consent: Operation Epic Fury

In February 2026, the Executive initiated a wide-scale aerial campaign against the sovereign nation of Iran. This action was taken without a Declaration of War, without an Authorization for Use of Military Force (AUMF), and in direct circumvention of the War Powers Resolution. By claiming "inherent Article II authority" to pursue regime change, the Executive has effectively stripped the People of their right to decide the blood-price of the nation’s foreign policy.

II. The Death of the Warrant: The May 2025 ICE Memorandum

The issuance of the May 12, 2025, memorandum regarding "Expedited Domestic Enforcement" represents the single greatest expansion of police power in a century. By authorizing federal agents to enter private residences using administrative forms (I-205) rather than judicial warrants, the administration has declared the Bill of Rights to be a "geographic suggestion." The tragic loss of life in Minnesota and Texas are the natural, violent results of a system that has removed the "Neutral Magistrate" from the door of the citizen.

III. The Purge of the Experts

Through the systematic use of executive orders to reclassify the civil service, the administration has moved to ensure that no institutional memory or legal expertise can check the will of the President. When the Department of Justice and the Department of Defense are staffed based on personal "loyalty tests," the checks and balances of the "Inner Cabinet" vanish, leaving the Republic vulnerable to the whims of the moment.
